<br />Councilmember Kuzma introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #20-131 <br /> <br />RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT FOR <br />A MONUMENT SIGN AND A DIRECTIONAL SIGN TO BE INSTALLED IN A <br />DRAINAGE AND UTILITY EASEMENT ON LOT 1, BLOCK 1 AMSTERDAM <br />EXTENSION AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Delta Modtech, hereinafter referred to as the “Applicant”, has requested an <br />Encroachment Agreement to facilitate the installation of a monument sign and directional sign (the <br />“Signs”) within a drainage and utility easement (the “Easement”) on the property legally described <br />as follows: <br /> <br />Lot 1, Block 1 Amsterdam Extension <br /> <br /> (“Subject Property”) <br /> <br /> WHEREAS, the Applicant must apply for and receive a Permanent Sign Permit to install <br />the Signs on the Subject Property; and <br /> <br /> WHEREAS, the Engineering Department is reviewing the request to determine if the <br />Easement can still function as designed with the encroachment of the Signs; and <br /> <br /> WHEREAS, the City Council reviewed the request on June 23, 2020. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That, contingent upon the Applicant entering into an Easement Encroachment Agreement <br />with the City and recording said agreement against the Subject Property, the Applicant <br />may install and maintain the Signs in accordance with the terms and conditions contained <br />within the Easement Encroachment Agreement. <br />2. That the final location of the Signs is contingent upon review and approval by the City <br />Engineer. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor LeTourneau <br /> Councilmember Kuzma <br /> Councilmember Riley <br /> Councilmember Heinrich <br /> Councilmember Menth <br /> Councilmember Musgrove <br /> Councilmember Specht <br /> <br />
