Councilmember Kuzma introduced the following resolution and moved for its adoption: RESOLUTION #20-131 RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT FOR A MONUMENT SIGN AND A DIRECTIONAL SIGN TO BE INSTALLED IN A DRAINAGE AND UTILITY EASEMENT ON LOT 1, BLOCK 1 AMSTERDAM EXTENSION AND DECLARING TERMS OF SAME WHEREAS, Delta Modtech, hereinafter referred to as the “Applicant”, has requested an Encroachment Agreement to facilitate the installation of a monument sign and directional sign (the “Signs”) within a drainage and utility easement (the “Easement”) on the property legally described as follows: Lot 1, Block 1 Amsterdam Extension (“Subject Property”) WHEREAS, the Applicant must apply for and receive a Permanent Sign Permit to install the Signs on the Subject Property; and WHEREAS, the Engineering Department is reviewing the request to determine if the Easement can still function as designed with the encroachment of the Signs; and WHEREAS, the City Council reviewed the request on June 23, 2020. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That, contingent upon the Applicant entering into an Easement Encroachment Agreement with the City and recording said agreement against the Subject Property, the Applicant may install and maintain the Signs in accordance with the terms and conditions contained within the Easement Encroachment Agreement. 2. That the final location of the Signs is contingent upon review and approval by the City Engineer. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Riley, and upon vote being taken thereon, the following voted in favor thereof: Mayor LeTourneau Councilmember Kuzma Councilmember Riley Councilmember Heinrich Councilmember Menth Councilmember Musgrove Councilmember Specht
