CC Regular Session <br />Meeting Date: 07/14/2020 <br />By: Tim Gladhill, Community Development <br />5. 11. <br />Information <br />Title <br />Adopt Resolution #20-147 Approving Expansion of Lawful, Non -Conforming Driveway at 15710 Saint Francis <br />Blvd NW <br />Purpose/Background: <br />The purpose of this case is to allow a gravel driveway extension in the R-1 Residential (MUSA) District. Driveways <br />in this district are generally required to be either asphalt or concrete. This parcel represents the original homestead <br />of the property that was eventually developed as River Pines along Highway 47 across from the Rum River Scout <br />Camp. <br />Notification: <br />Notification is not required. <br />Observations/Alternatives: <br />The Owner is looking to relocate an accessory building and reconstruct a gravel driveway as part of that project. <br />There are enough layers of lawful, non -conforming and discussions on future use of the Property that concurrence <br />with City Council action will assist Staff in finalizing this Application. <br />Additionally, in recent past, the Owner has discussed subdividing the property to allow additional dwellings to be <br />constructed on the Property. Staff is establishing a clear record that this current action is no indication of supporting <br />said subdivision. Staff raises this clarification as there are several challenges in subdividing the property and wants <br />to ensure that this action today isn't interpreted as allowing said future subdivision. <br />The Applicant will be asked to sign a confirmation that they have received the terms above. <br />Alternatives <br />1. Approve Driveway Extension as a Gravel Driveway as an expansion of a pre-existing, lawful, <br />non -conforming driveway. <br />2. Require that the Driveway Extension comply with current City Code and require to be paved. <br />Funding Source: <br />Staff is handling this case as part of normal Staff duties. <br />Recommendation: <br />Staff recommends adoption of the resolution allowing the driveway extension as gravel. <br />Action: <br />Motion to adopt Resolution #20-147 approving expansion of lawful, non -conforming driveway. <br />Attachments <br />Site Plan Packet <br />
