9. That due to the COVID-19 pandemic and its economic impacts, the Permittee has requested <br />an Amended Conditional Use Permit to extend the timeframes for completing certain <br />required paving improvements related to the allow for motor vehicle sales and detailing <br />operation on the Subject Property by two (2) years. <br />10. That City Code Section 117-356 (Commercial and Industrial Development Off -Street <br />Parking) requires one (1) dedicated customer parking space for every ten (10) vehicles <br />displayed; three (3) dedicated customer parking spaces for each enclosed bay; and one (1) <br />dedicated parking space for each full time employee. <br />11. That vehicles displayed for sale, or those that have been detailed, shall be restricted to <br />bituminous or concrete surfaces only. <br />44,12. That there are existing Zoning Code violations on the Subject Property regarding <br />temporary signage and lighting. <br />12.13. That the Planning Commission met on March 1, 2018June 4, 2020, conducted a <br />public hearing and recommended City Council approve-al-ef the request. <br />FINDINGS OF FACT <br />1. That motor vehicle sales and detailing will not be unduly dangerous or detrimental <br />to persons residing or working in the vicinity of the use, or to the public welfare. <br />2. That motor vehicle sales and detailing will not substantially adversely impair the <br />use, enjoyment or market value of any of the surrounding properties. <br />3. That the motor vehicle sales and detailing operation will be maintained so as to be <br />harmonious and appropriate in appearance with the existing or intended character <br />of the general vicinity and will not change the essential character of the area. <br />4. That motor vehicle sales and detailing will not be hazardous to existing or future <br />neighboring uses. <br />5. That motor vehicle sales and detailing will not impact essential public facilities and <br />services, such as highways, streets, police and fire protection. <br />6. That motor vehicle sales and detailing will not create excessive additional <br />requirements at public cost for public facilities and services and will not be <br />detrimental to the economic welfare of the community. <br />7. That motor vehicle sales and detailing will not involve uses, activities and <br />equipment that will be detrimental to any persons, property, or the general welfare <br />by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. <br />RESOLUTION #20-101 <br />Page 2 of 6 <br />
