CC Regular Session 7.4. <br />Meeting Date: 06/23/2020 <br />By: Chloe McGuire Brigl, Community <br />Development <br />Information <br />Title: <br />Adopt Ordinance #20-14 Vacating Right of Way and Drainage and Utility Easements (Case of Capstone Homes <br />and City of Ramsey); Project 19-149 <br />Purpose/Background: <br />The purpose of this case is to review a vacation of the underlying drainage and utility easement related to the Puma <br />Street realignment project. This is a standard processes for the City of Ramsey during this type of street <br />reconstruction project. <br />Also included in this case is a resolution updating the legal description of real property to be conveyed to Capstone <br />Homes as part of the realignment of Puma Street. This has previously been approved and is necessary to complete <br />the Riverstone Plat. This step is to simply update to the actual legal description at time of closing of the transaction. <br />Notification: <br />Public Hearing notices were sent via Standard US Mail to Property Owners within 700 feet of the Subject Property, <br />as reflected by Anoka County Property Records. A notice was published in the Anoka Union Herald, the City's <br />official newspaper for the June 9, 2020 City Council meeting. <br />Notification for this particular meeting is not required and has not been provided. <br />Observations/Alternatives: <br />Ordinance #20-14 <br />• Right of Way Vacation: In order to realign Puma Street NW, the existing Puma Street must be vacated. This <br />step must be approved via an Ordinance from the City Council per City Code. <br />• Drainage and Utility Easement Vacation: In order to realign Puma Street NW, underlying drainage and <br />utility easements must be vacated along the edges of the existing property. New drainage and utility <br />easements will be dedicated with the Final Plats for the road realignment (Alpha Development 2nd Addition) <br />and Riverstone 4th Addition. This process ensures clean title work and keeps the process running smoothly <br />with Anoka County. <br />Funding Source: <br />The Applicant is responsible for all costs associated with project. <br />Recommendation: <br />Staff recommends adoption of the final plat and introducing the vacation of drainage and utility easements related <br />to the Puma Street realignment project. <br />Action: <br />
