CASE <br /> <br />REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK; <br />CASE OF DAN AND THERESA CARTER <br /> By: Patrick Trudgeon, Principal Planner <br /> <br />Background: <br /> <br />Mr. and Mrs. Carter have applied for a variance to encroach into the rear yard setback in order to <br />construct an addition onto their principal structure on the property located at 14531 Sunfish Lake <br />Dr. NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Pictures of the property <br />d) Proposed Findings of Fact <br />e) Proposed Variance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />The Carters would like to construct a four-season porch addition to their residence. Since the <br />addition will be habitable space, they are required to adhere to the setbacks for the R-1 Zoning <br />District. The required rear yard setback is 35 feet. With the construction of the addition, the <br />Carters will be 20.5 feet from the rear property line; a rear yard encroachment of 14.5 feet. <br /> <br />The Carter's house is a corner lot and is surrounded by three streets (See site plan). The Carters <br />cannot construct the addition on their western side of their lot (145th Avenue) since the principal <br />structure is already at the required setback line and the proposed addition would not fit on the <br />property. They also cannot construct on the eastern side of the lot, since the addition would <br />encroach in the required 10' side yard setback. Therefore, the Carters are asking for a variance <br />to the rear yard setback as they believe it will have the least impact to the surrounding property <br />owners. <br /> <br />As the rear lot line of the Carter's lot abuts the right-of-way for Sunwood Drive, granting the <br />variance to the rear yard setback will not impact any neighbors to the south. <br /> <br />Recommendation: <br /> <br />Based on the above observations, staff recommends approval of the variance. <br /> <br /> <br />
