CASE # t <br />REQUEST FOR A VARIANCE TO SEPTIC SYSTEM SETBACK REQUIREMENTS; <br /> CASE OF JIM AND JOANNE KUSLER <br /> By: Patrick Trud§eon, Principal Planner <br /> <br />Background: <br /> <br />Jim and Joanne Kusler have applied for a variance from the minimum separation between a septic <br />tank and building in order to replace their failed septic system on the proPerty located at 16941 <br />Yttrium St. NW. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Letter from Leshinski Services, Inc. septic system designer dated September 12, 2001 <br />c) Site plan <br />d) Letter from Glyn Huff, Building Official, City of Ramsey regarding variance request. <br />e) Site photographs <br />f) Proposed Findings of Fact <br />g) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify all owners of property within 350 feet <br />of the subject property of the request for variance and public hearing date. <br /> <br />Observations: <br /> <br />The Kuslers are asking for a variance in order to replace their failing septic system. The area that <br />was used previously for the drainfield has disturbed soils and cannot be used again. The existing <br />1250-gallon tank, however, can be used again. The Kuslers have limited area where they can put <br />the new drainfield since their well is located in the front yard and the drainfield is required to be <br />located 50 feet from any wells. State law requires the drainfield to be setback 10 feet from the lot <br />line and 20 feet from a residence. The Kuslers are requesting a variance to locate the drainfield <br />five feet from the north property line and ten feet from the residence. <br /> <br />Ramsey Building Official Glyn Huff has reviewed the request and indicates support of the <br />variance since there is no choice for another location if the applicant is to maintain the 50-foot <br />separation from the well. Building Official Huff also states that the flow of the drainage will be <br />directed away from the basement due to the slope of the lot and therefore the location of the <br />drainfield ten feet from the house should not cause any problems. <br /> <br />Staff learned on October 29, 2001 that the septic system was installed by Scott Salonen during the <br />week of October 22. Mr. Salonen indicated that he knew that the septic system needed a variance. <br />prior to installation, but installed it anyway. <br /> <br /> <br />
