CASE <br /> <br />REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK; <br />CASE OF CHAD AND MICHELE HOUDE <br /> By: Patrick Trudgeon, Principal Planner <br /> <br />Background: <br /> <br />The Houdes have applied for a variance to encroach into the rear yard setback in order to <br />construct an addition onto the principal structure on the property located at 6831 146th Circle, <br />NW. In reviewing the need for a variance, it was found that the existing structure already <br />encroaches into the rear yard setback. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan <br />c) Pictures of the Houde property <br />d) Proposed Findings of Fact <br />e) Proposed Variance <br /> <br />Observations: <br /> <br />Mr. and Mrs. Houde would like to construct a 16' x 21' addition onto their home due to their <br />growing family. The addition is proposing to encroach twenty feet into the 35-foot rear yard <br />setback established in the R-1U Residential district. <br /> <br />The Houdes house was constructed in 1998 and encroaches approximately 8.5 feet into the rear <br />yard setback. Staff finds no record of a variance granted for this lot and is unable to determine <br />why the house was constructed in the rear yard setback area. Nevertheless, a variance will be <br />needed to allow for the existing setback encroachment. <br /> <br />The lot is pie shaped and is located at the end of the 146th Circle cul-de-sac. The property has <br />residences to the north and south and abuts the landfill property to the east. The existing <br />residence is situated in such a way to make any proposed addition to the house encroach into the <br />existing rear yard setback. <br /> <br />If the variance is granted, the residence will be located no closer than 32 feet from the side <br />(south) property line and 15 feet from the rear lot line. <br /> <br />The Houdes are asking for a variance to encroach the rear yard setback on the southeast portion <br />of their lot as they believe it will have the least impact to the surrounding property owners. As it <br />relates to the existing structure encroachment, they have no option besides tearing down the <br />structure if they are required to conform to the required setbacks. <br /> <br /> <br />
