Voting No: None.

PUBLIC HEARINGS/BOARD BUSINESS

Case #1:

Request for a Variance to the Rear Yard Setback; Case of Karl and Beth
Virkus

Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:00 p.m. in
order to conduct the public hearing.

Public Hearing

Chairperson Nixt called the public hearing to order at 7:00 p.m.

Presentation

Community Development Assistant Wald stated that Mr. Davis had applied for a variance to
encroach into the rear year setback in order to construct an addition onto the principal structure
on the property located at 16940 Azurite Street NW. The addition is proposed to encroach five
feet into he 35-foot rear yard setback established in the R-1R Rural District. Mr. Virkus's house
was built in the 1970's when the policy was to construct houses to one side of the lot so as not to
obstruct any future resubdivision. The Virkus's home is located along the very north edge of the
subject property. The addition cannot extend any further to the north without encroaching into
the side yard setback. The property also contains heavy vegetation and low areas along the
southern portion of the property and therefore prohibits the construction of a detached accessory
building. The proposed addition also cannot extend any more to the south due to the location of
the well. The proposed addition will not exceed the accessory building square footage
restrictions established in City Code. The subject property is 1.3~acres in size and the City Code
allows 1,664 square feet of accessory building space. The proposed entry and garage addition
will consist of 1,600 square feet and the property does not contain any other accessory buildings
that count against the total allotment of accessory building space. Due to the location of the
house, the well, and the property containing heavy vegetation and low areas in the southern
portion of the subject property, staff recommended approval of the variance.

Citizen Input

There was none.

Motion by Board Member Johnson, seconded by Board Member Watson, to close the public
hearing.

Board of Adjustment/June 5, 2001
