Chairperson Nixt inquired whether Mr. Voit has had discussions with neighbors. <br /> <br />Mr. Voit responded he did have discussions with both his southern and northern neighbors and <br />they did not have any objections. He added that he spoke with everyone in the neighborhood <br />except his neighbors across the road. He said no one expressed a problem with his plans. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Sweet, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Sweet, Kociscak, <br />Reeve, and Watson. Voting No: None. <br /> <br />The public hearing closed at 7:14 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:14 p.m. <br /> <br />Chairperson Nixt questioned whether there was adequate clearance to get equipment to the back <br />of the site if necessary. <br /> <br />Principal Planner Tmdgeon said there would not be adequate room for equipment. There is a <br />fence there currently. He explained that without the variance, the maximum space would be 10 <br />feet. <br /> <br />Chairperson Nixt inquired what was needed for clearance. <br /> <br />Community Development Director Frolik stated that according to the engineers, 10 feet is what <br />is needed for easement. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson, to adopt Resolution <br />#01-10-371 adopting Findings of Fact, favorable to the applicant, relating to Gary Voit's request <br />for a variance to encroach 12 feet into the comer side. yard setback on the property located at <br />6198 146th Avenue NW. <br /> <br />Further discussion: Board Member Johnson stated he agreed with the granting the variance <br />because of the shape of the lot. It is unique. He said even if the playground wasn't in place, he <br />would have supported it. Chairperson Nixt voiced his opinion that he didn't disagree with it. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Watson, Kociscak, <br />Reeve, and Sweet.
