Ivlr. f)cterson indicated there is a stand of trees which they are proposing to leave undisturbed, <br />and the question is if that will be privately owned or if the City should own it. He stated they <br />would be comfortable putting covenants on it that would prohibit the association from building <br />~m it in thc future. He indicated the wetland fill necessary is very small; only one creek crossing, <br />m~d all other wetlands are being avoided. He stated that with the exception of one lot this meets <br />thc wetland buffer ordinance being considered by the Planning Commission tonight. He stated <br />this development seems to meet COde in most cases, without the Planning Commission having to <br />ask for modifications. <br /> <br />Mr. Peterson indicated this is the way the site laid out. He stated the dilemma the Planning <br />¢iommission is facing is how to write something that will work in all or most situations. <br /> <br />Chairperson Nixt indicated that what Commissioner Brauer has touched on is a fundamental <br />i,~;stm they arc facing. He stated as the City starts to run the MUSA line out the Planning <br />Commission has been given authority to run it where they feel it is best.
