CASE # <br /> <br />REQUEST FOR APPROVAL OF A METES AND BOUNDS SUBDIVISION; <br />CASE OF EDWARD AND LORA HAMILTON <br /> By: Sylvia Frolik, HRA Exec. Dir./Asst. Comm. Dev. Dir. <br /> <br />Background: <br /> <br />Ed and Lora Hamilton currently reside at 6615 Hwy. #10 N.W. Their property is included in the Official <br />Map fi)r the future construction and expansion of Hwy. #I0 N.W. The City recently completed <br />negotiations with the Hamilton's to acquire their property, utilizing the regional Revolving Acquisition <br />Loan Fund. <br /> <br />Notification: <br /> <br />No notification is required for metes' and bounds subdivisions. <br /> <br />Observations: <br /> <br />The terms of the sale include a requirement for the Hamilton's to vacate the property within 180 days. <br />The Hamilton's own approximately 11 acres of property south of Riverdale Drive, just southwest of the <br />Comkbrt Suites Hotel. They would like to subdivide 1.5 acres from this 11 acre parcel for the purpose of <br />creating a building site for their new home. City Code requires subdivisions to be accomplished through <br />the platting process. However, City Code also states that City Council has the authority to waive the <br />platting requirements when they create unnecessary hardship and failure to plat doesn't interfere with'the <br />purposes of the subdivision chapter. The Hamilton's are requesting a waiver to the platting requirement <br />in order' to expedite their new home construction and facilitate compliance with the terms of the sale of <br />their property on Hwy #10. <br /> <br />The buildable lot created by the subdivision will be subject to the following fees: park dedication, <br />stormwater management, trail development, sewer and water trunk services, and sewer and water lateral <br />serviccs~ <br /> <br />The ~bllowing items are enclosed: <br /> <br />a) <br />b) <br /> <br />Site location map <br />Sketch of proposed subdivision <br />Proposed resolution to approve a subdivision by metes and bounds description <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the metes and bounds subdivision for the following reasons: <br /> <br />a. the require~nent for platting would be an unnecessary delay to the Hamilton's relocation plan; <br />b. the proposed building site is part of a much larger parcel, that is likely to be platted in the <br /> future; . · <br />c. the proposed lot split is a simple one .that does not interfere with the purposes of the <br /> subdivision regulations. <br /> <br />· .,209- <br /> <br /> <br />
