lawn. S taft is also requesting that the developer plant appropriate seeding specifications within a portion
ot:' thc no mow zone to further establish and protect the wetland areas.

The proposed plat was reviewed for park dedication and trail requirements by the Park Commission at
their April 14, 2005 meeting. The Park Commission recommended that park dedication and trail fees be
satisfied through a cash payment. The preliminary plat is providing a bituminous trail along County
l~:oad 5 and is providing a pedestrian connection within the plat from Quicksilver Circle to the proposed
trail along County Road 5. The proposed trail configuration complies with the desires and
recom~nendation established by the Park and Recreation Commission.

The Planning Commission held a public hearing and reviewed the preliminary plat and site plan on April
7, 2005. During the public hearing, several residents stated their opposition to the proposed
development.

Rccommendation:

The Planning Commission was relatively split on this development. A motion was made to approve the
pretimi~ary plat and site plan with a couple contingencies related to compliance with the staff review
letter and resolution of Potassium Street. The vote failed one a 3:3 vote. A second attempt at a motion
was made to deny the preliminary plat and site plan based on inappropriate use of PUD, utilization of the
townhomes, Potassium Street issue unresolved, and crowding of townhouse units 1-14. The motion
passed on a 3:2 vote with 1 member abstention.

Subsequent to the Planning Commission meeting, the applicant, City Staff, and the City Attorney met to
discuss the outstanding issue of Potassium Street. Staff asked Shade Tree to look at ways to shift
Potassium Street to the west. They submitted a revised Site plan that shows the road being shifted along
their property line and then providing a 25 foot easement solely within their property to allow for
adequate snow storage area. Generally speaking, this would allow the ability to save a significant amount
of trees that would have otherwise been removed to facilitate the construction of Potassium Street down
the center of the 60 foot right of way. The realignment to the west also provides the neighbors with
additional green space between their property line and the proposed development. As mentioned above,
staff is meeting with the neighbor's attorney to discuss this option and will verbally report the results at
the City Council meeting the results.

Council Action:

Motion to approve the preliminary plat contingent upon compliance with City Staff Review Letter dated
April 1, 2005, revised May 6, 2005 and upon receiving a rezoning to PUD.

-and~

M(;tion to approve the site plan contingent upon compliance with City Staff Review Letter dated April 1,
2005, revised May 6, 2005.

Motion to deny the preliminary plat and site plan..

CC: 5/1t}/05

-217-
