Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #05-XX-XXX A RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL OF SHADE TREE COTTAGES. WHEREAS, Shade Tree Communities, LLC, hereinafter referred to as "Applicant", has properly applied for preliminary plat approval of Shade Tree Cottages on the following described property located in the City of Ramsey: All that part of the Northeast Quarter of the Northwest Quarter of Section 23, township 32, Range 25, lying east of the easterly right-of-way of County State Aid Highway No.5, Anoka County, Minnesota. (the "Subject Property") sketch and WHEREAS, on November 20, 2004, the City of Ramsey received an application and plan from Shade Tree Communities, LLC, for a plat to be named Shade Tree Cottages; WHEREAS, on January 6, 2005, the Planning Commission reviewed the sketch plan; and WHEREAS, on' January 25, 2005 and February 22, 2005, the City Council reviewed the sketch plan; and WHEREAS, on March 15, 2005, the Developer submitted a preliminary plat for Shade Tree Cottages to the City; and WHEREAS, on April 7, 2005, the Planning Commission conducted a public hearing and recommended 'the City Council deny the preliminary plat; and WHEREAS, on April 14, 2005, the Park and Recreation Commission recommended park dedication and trail fees be satisfied through a cash payment; and WHEREAS, on May 10, 2005, the City Council'reviewed the preliminary plat for Shade Tree Cottages; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA; That the Ramsey City Council hereby ~~ preliminary plat approval to Rum River Estates contingent upon compliance with City Staff Review Letter dated May 6, 2005. -238-
