P.W. CASE #

UPDATE ON 141sr AVENUE NW AND EBONY STREET NW IMPROVEMENT
By: Brian E. Olson, City Engineer

Background:

On July 25, 2000, the addition of 141st Avenue NW and Ebony Street NW were authorized.
Design of the street and utility is being completed by Hakanson Anderson Associates and the
negotiations for right of way was being done by Evergreen Land Services.

Observations:

The purpose of the case tonight is to give you an update of the negotiations that have occurred
and get some direction on how to proceed. The development agreement with T&G Land (Tom
Sauter) have assured the streets and utilities to his site by July 1, 2001. Currently, there are two
properties that are affected with right of way acquisition. Commercial Asphalt has been willing
to work with Staff as they seem excited to see the construction of a public road and improvement
to the area. The attached exhibit illustrates the land swap that we have proposed to them
regarding the right of way.

The second parcel that we have been looking to acq:fire for public purpose is the property south
of the section line that would allow for the extension of 141st Avenue NW. The property is
currently owned by St. Paul Terminals aka Danny's Tranny. We have had two meetings with Mr.
Jeff. Schott and he is asking for the following in exchange for this parcel:

The scale moved to north side of his north parcel.
A 30 ft. x 30 ft office building to be built by us.
· The door on the north side of his building be constructed shut.
· A new door created on the east side of his building.
· A well abandoned and water provided.
· Staff assistance in approving sketch site plan with consideration given regarding variances for
setbacks.

Staff will have options for the continuation of 141 st Avenue NW available for the meeting.

Committee Action:

Based upon discussion

Reviewed by:

City Administrator
Director of Public Works

PW: 2/20/00
