The vendor was looking for an opportunity to demonstrate the advantages of using tire chips as fill over soft ground. Staff felt the proposal had merit, and the City is looking at constructing trails over soft ground in the future. Staff prepared plans for test sections to compare the tire chips to trail construction methods previously used in the City. project. Motion by Councilmember Cook, seconded by Councilmember Elvig, to ratify the recommendation of the Public Works Committee in Cases 1 through 5 and Case No. 8 and to: Adopt Resolution #05-04-101 Receiving the Feasibility Report and Calling for a Public l learing on Improvement Project #05-24, and to offer a lock on the cost of the assessments to the residents. Authorize staff to sign the plans for the CSAH 116/Thurston Avenue/Dysprosium Street p,'ojcct. Authorize updated appraisals for Premier and Hunter investment properties. Authorize the use of eminent domain and direct staff to continue negotiations for an agreed price on the parcel south of Elmcrest Park owned by Mr. Lynn Mortenson, and to authorize staff to work under the authority of acquiring a right-of-entry or trail easement, which would allow the trail to be built while negotiations are proceeding. ~ Authorize staff to develop the maintenance agreement as outlined above, including a statement in the certificate of liability regarding the City not having any liability for issues such as pilings sinking or the patio floor cracking.
