P.W. CASE #: 5 <br /> <br />CONSIDER POLICY ON REMOVAL OF "TEMPORARY" EROSION CONTROL MEASURES <br /> By: Brian E. Olson, City Engineer <br /> <br />Background: <br /> <br />On April 17, 2001, the Public Works Committee directed Staff to consider a policy on the removal of <br />"temporary" erosion control measures. <br /> <br />Observations: <br /> <br />During Capital Improvement projects that the City of Ramsey oversees and administers, it is the <br />Contractor's responsibility to install temporary erosion control measures before commencement of work, <br />maintain them throughout the construction project, and remove them upon successful turf establishment. <br />This is normal practice and occurs regularly. <br /> <br />Commercial and industrial developments are quite similar generally because they encompass only one <br />site and the City can require that they establish turf. Once the improvements are done on their site, the <br />responsibility to remove the temporary erosion control measures is borne by the developer/owner. <br /> <br />Residential developments are different in nature. The Contractor that installs the silt fence and performs <br />the rough grading of the entire subdivision typically has completed his work well before, sometimes <br />years before, the turf has been established. These temporary erosion control measures typically are <br />overlooked, removed by the City of Ramsey, or removed by the new residents. <br /> <br />This case can be addressed in a number of ways: <br /> <br />City of Ramsey takes responsibility of removing silt fence for residential developments. We add a <br />$500 charge to the residential development agreements to help cover the costs of said activities as a <br />Phase II Improvement and then operate on a complaint basis to remove the facilities once turf has <br />been established. <br />We add a new requirement to our residential development agreements stating that the developer has <br />to successfully establish turf and remove the silt fence prior to release of any escrow. This is the <br />preferred method of handling this situation and it is something that the developers should not be <br />adverse to since they are required by the MPCA and WMO to establish turf before the removal of <br />erosion control measures. <br /> <br />The purpose of the case is to get further direction from the Public Works Committee.
