Leapfrog Development <br /> <br />This section shall apply to leapfrog development which is development that requires or results in: <br />la] extending sewer and/or water to a petitioning property when there are no existing service <br />lines within a bordering property or within a bordering right-of-way at the time the petition is <br />filed, or lb] extending sewer or water past or within a non-petitioning property that did not <br />previously have utilities. <br /> <br />8.9.i Feasibility Study for Leapfrog Development and Escrowed Revenue <br />The feasibility study for any proposed leapfrog extension of sewer and/or water shall identify all <br />existing commercial and residential properties adjacent to proposed routes. For each identified <br />property, the feasibility study shall clearly state whether it will be considered to have sewer- <br />and/or water available to it at the conclusion of the project, as a result of the project. For each <br />non-petitioning property identified as having sewer and/or water made available at the <br />conclusion of the project, the city shall collect from the petitioning properties as part of the total <br />pro~ect cost an amount equal to all fees and charges that normally would be assessed and <br />collected l'rom each non-petitioning property if it were to connect. This revenue will be held <br />apart fi:om general funds in the Household Protection Escrow Account, for the purposes set forth <br />in the Charter and will be part of the total project cost assigned to and paid by petitioning <br />properties. Once contracts are awarded no amount may be charged nonrpetitioning households <br />beyond the escrowed amounts set aside into the Escrow Account, however, the City may adjust <br />the amount collected from petitioning parties, if needed, due to changes in construction cost or to <br />fully protect non-petitioning households. <br /> <br />8.9.2 Petition Process <br />Propert. y owners who petition for an improvement shall be provided service and shall share in the <br />cost. Provisions of the entire petition process contained in the charter shall apply and each <br />property owner adjacent to any proposed sewer or water main or lateral route(s) shall be <br />considered a stakeholder and thus permitted to participate in petitioning for or against the <br />proposed improvement. As used in this charter, "'adjacent" shall mean a property that shares a <br />common border with any parcel proposed to contain the improvement or any property that shares <br />a common border with the right-of-way or easement proposed to contain the improvement. <br />Stakeholder majorities for or against an improvement shall be tallied based upon buildable lots of <br />record as of the petition date, not as proposed after an extension is built. Each buildable lot shall <br />have a single vote, and each existing stakeholder dwelling shall have a single vote. <br /> <br />8.9.3 Required Petition for Leapfrog Development Required <br />The city shall not fund seWer or water extension to leapfrog development if there are no <br />pctifio~aer(s) willing to sponsor and pay the entire cost. <br /> <br />8.10 Effective Date <br />This amendment shall be effective immediately upon approval of the voters. <br /> <br />-85- <br /> <br /> <br />
