Counci hn e~nber Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/405-04-096 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0718 TO REZONE CERTAIN <br />PROPERTY FROM R-2 MEDIUM DENSITY RESIDENTIAL TO PUD - PLANNED <br />.UNIT DEVELOPMENT <br /> <br /> WHEREAS, on March 1, 2005, the City received an application to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSE¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Brightkeys, Inc, hereinafter referred to as "Applicant," has properly applied to <br />rezone certain property from R-2 Medium Density Residential to PUD - Planned Unit <br />Development. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />thc City Code on March 3, 2005 and said public hearing was properly advertised, and the <br />mim~tes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />Lots 1-5, Block 1; Lots 1-32, Block 2; Lots 1-11, Block 3; Lot 26, Block 5; <br />Outlot C; and Outlot D; Town Center Gardens 3rd Addition, Anoka County, <br />Minnesota <br /> <br />4.. That the area of the property to be rezoned is approximately 25 acres in size. <br /> <br />5. That the Subject Property is currently zoned R-2 Medium Density Residential and is <br /> located within the boundaries of the current Metropolitan Urban Service Area (MUSA). <br /> <br />6. That the Comprehensive Plan designates the property for Medium Density Residential <br /> development. <br /> <br />That the Rezoning Request will allow for a combination of townhomes and single-family <br />lots on the Subject Property, as well as deviations from single-family lot standards and <br />setbacks as required in the R-1 District. <br /> <br />8. ri'hat the proposed zoning amendment will not substantially adversely impair the use or <br /> market value of any surrounding property. <br /> <br />9. That the proposed zoning amendment will not change the essential character of the area, <br /> which is residential. <br /> <br /> <br />
