City Engineer Olson presented the Committee with a map indicating the problematic areas. <br /> <br />Attorney representing the Pehlke's stated that the Pehlke's do not have a drainage problem and <br />never have had a drainage problem. The City has never offered to compensate the Pehlke's at all <br />for the impact it will have on their property and there is an alternate route that would not affect <br />the Pehlke's property. The Attorney noted that they would not have an objection to a 30-day <br />extension. <br /> <br />City Administrator Norman stated that the alternative is a proposal between Mr. Fisher and the <br />Pehlke's, but is not something that the City would suggest. <br /> <br />Councilmember Hendriksen inquired if the City traditionally takes an easement during the <br />plating process. <br /> <br />City Engineer Jankowski explained that the City does .take an easement of 10 feet along the front <br />of the property and 5 feet on the sides and back of the property. In the case of the Pehlke's <br />property staff is proposing a 20-foot easement, 10 feet on either side of the lot, to accommodate a <br />storm system. <br /> <br />Councilmember Hendriksen inquired if the standard easement distances are included in Chapter <br />9 of City Code. <br /> <br />City Engineer Jankowski was unable to answer the question, but noted that the setback standards <br />have been practice since 1990. <br /> <br />Councilmember Zimmerman inquired if the Pehlke's main complaint with the easement is that it <br />is for a sub-regional storm sewer system. <br /> <br />Attorney representing the Pehlke's replied that the problem is the taking of private property <br />without compensation for the benefit of other properties. <br /> <br />Councilmember Zimmerman inquired if there were any other issues. <br /> <br />Mr. Pehlke replied that 75 pine trees would be removed if the storm sewer were constructed. <br /> <br />Councilmember Hendriksen inquired if the 20-foot easement was needed for construction <br />purposes only. <br /> <br />City Engineer Jankowski replied that the pipe could be installed within the 20 feet, but noted that <br />it would be easier if they could obtain a temporary easement in addition to the 20 feet. <br /> <br />Councilmember Hendriksen inquired if the 20-foot easement would be needed after construction. <br /> <br />City Engineer Jankowski replied yes, in case it needs maintenance. <br /> <br />Public Works Committee/March 20, 2001 <br /> Page 3 of 9 <br /> <br /> <br />
