Graven's opinion regarding the issue is flawed and weak, and they feel that the City needs to <br />fight for the Charter Amendment. <br /> <br />Winslow Holasek, 1159 Andover Boulevard, Andover, stated that the property owners along <br />Highway #10, south of Sunfish Lake Boulevard, were presented with condemnation papers for <br />the Mississippi storm sewer improvement project. <br /> <br />Mayor Gamec replied that the issue will be on the January 23rd City Council agenda. <br /> <br />Mr. Holasek replied that many of the people don't believe that the project is a good thing. He <br />stated that he had a petition from the affected property owners respectively requesting that the <br />Ramsey City Council not construct the project at this time. They feel that the project is <br />premature because the property, in its present state, does not require the improvements and most <br />of the property is not sufficiently developed to support the tax and could cause some of the <br />property to be forfeited. <br /> <br />Jerry Fischer, Rivenwick Homeowners Association, stated that they are concerned about the <br />Density Transition Ordinance not being adopted. He presented the Council with a letter from the <br />Law Firm ofBassford, Lockhard, Trusedell, & Briggs, P.A. which stated the following: <br /> <br />"Our office has been retained by the Rivenwick Homeowners Association to review whether or <br />not the City Council has complied with provisions of the Ramsey City Charter. Specifically, we <br />have been requested to review whether or not the City Council has complied with the will of the <br />voters as expressed in the special election September 1997, regarding community development <br />standards. We understand that the City Council may be in the process of not passing an <br />ordinance to more fully define and make lawful an ordinance implementing the will of the voters <br />as expressed in the special election in 1997. We have been provided with portions of the City <br />Charter and specifically have reviewed Section 12.12, as you are aware, requires the Council to <br />take appropriate actions to make affective provisions of the Charter. Given the fact that the <br />voters of Ramsey specifically amended the Charter to include particular community development <br />standards, the City Council, pursuant to the provisions of the City Charter, must pass an <br />ordinance to implement the voters will. My client is hopeful that the City Council will take <br />whatever action is necessary to pass an ordinance to implement the voters expressed will <br />regarding community development standards." <br /> <br />Sharon Zagaros, 9031 178t~' Avenue NW, Ramsey, stated that she had questions regarding the <br />Tower Overlay District and inquired if she would have an opportunity to ask those questions <br />when the case is discussed. <br /> <br />Mayor Gamec replied yes. <br /> <br />John Bertzyk, 6001 - 146*h Avenue NW, Ramsey, inquired if it would be possible to have the <br />agenda printed in the Anoka County Union paper prior to the meeting. <br /> <br />City Council/January 9, 2001 <br /> Page 5 of 35 <br /> <br /> <br />
