City Engineer Jankowski explained that the issue had to do with City staff requesting that the <br />drainage and utility easement be widened to 20 feet rather than five feet to accommodate <br />drainage for the adjacent vacant property when it is developed. The concern of the Pehlkes is <br />that if they construct the drainage pipe under their property there will be several large white pine <br />trees impacted. <br /> <br />Betty Pehlke, 5566 - 152''d Avenue NW, Ramsey, replied that she is generally opposed to the 20- <br />foot easement. She explained that in 1994, Ramsey Meadows second addition was platted to the <br />south of their property and Outlot A was created because the lot was not large enough for a house <br />to be constructed on. The developer attempted to purchase a pbrtion of their property to make <br />Outlot A buildable, but they declined his offer. Eventually they purchased Outlot A so that their <br />property was not landlocked. Ms. Pehlke explained that the existing holding pond is located next <br />to their garage and if the drainage pipe were constructed it would take out 100 to 125 feet of 40 <br />foot tall white pines. The Pehlkes do not feel that they have created any drainage problems and <br />don't feel they should have to take care of drainage for a future development. <br /> <br />Community Development Director Frolik noted that the issue of the drainage easement is not <br />related to this case, but will be addressed at a future City Council meeting. <br /> <br />Councilmember Zimmerman inquired if the City can legally drain water onto private property. <br /> <br />City Attorney Goodrich replied that the City can only drain onto private property with the <br />property owner's permission. <br /> <br />Councilmember Zimmerman stated that he did not think that the Pehlkes should have to accept <br />someone else's drainage. <br /> <br />City Engineer Jankowski stated that the drainage for the area could be a problem in the future, <br />but indicated that are other alternatives. <br /> <br />Ms. Pehlke inquired if there is going to be future development why can't there be another <br />holding pond constructed as part of that development. <br /> <br />City Engineer Jankowski replied that a pond would probably be created as part of the <br />development, but explained that a pond can only hold so much water and would need an outlet. <br /> <br />David Pehlke, 5566 - 152"d Avenue NW, Ramsey, stated that he had talked to another resident <br />about sewer pipes and they had told him that the sewer pipes are full of sewer rats. <br /> <br />Mayor Gamec inquired if the applicant would like the City Council to postpone their decision to <br />allow them time to work with staff. <br /> <br />Ms. Pehlke requested that the Council table action and agreed to waive the 60-day decision rule. <br /> <br />City Council/January 23, 2001 <br /> Page 18 of 34 <br /> <br /> <br />
