to sell Outlot A because they need the area for snow storage and a vision triangle for their store. <br />If there is an issue of creating a landlocked parcel they will work through that prior to final plat. <br /> <br />Councilmember Hendriksen noted that preliminary plat is a process when an individual gains a <br />certain set of rights. <br /> <br />City Attorney Goodrich inquired as to where the City was regarding the 60 day decision rule. <br /> <br />Community Development Director Frolik replied that the 60-day decision rule is not an issue. <br /> <br />Councilmember Zimmerman inquired if the developer would like to exclude Outlot A from the <br />plat. <br /> <br />Mr. Slettner replied that they could remove Outlot A from the plat or the Rademacher's could <br />grant themselves an easement to Outlot A so that the property would not be landlocked. <br /> <br />Councilmember Kurak inquired if Rademacher could combine the two parcels so that there is <br />only one pin number. <br /> <br />City Engineer Jm~kowski suggested re-platting the Rademahcaer property as part of this <br />development and then the extension of Cobalt Street could be included in the plat and the <br />concern over Outlot A could be addressed. <br /> <br />Mr. Slettner stated that they will resolve the issue to the City's interest so that there is not a <br />landlocked parcel. He recommended a motion stating that the landlocked parcel has to be <br />eliminated. Mr. Slettner explained that during the last City Council meeting there was a lot of <br />discussion regarding the Planning Commission meeting comments and the neighbors were <br />disappointed that they did not know of the Council meeting. The neighbors did show up at the <br />last Planning Commission meeting to express their support and noted that some of those <br />residents were also present at this Council meeting. He also noted that letters froln residents <br />have also been forwarded to the Council supporting the project. <br /> <br />Councilmember Zimmerman inquired if the MnDOT drainage permit had been reviewed. <br /> <br />City Engineer Jankowski replied that a permit is required for the developer to discharge into the <br />structure on MnDOT right of way. <br /> <br />Mr. Slettner noted that the permit application is in, but the permit has not been received. <br /> <br />Community Development Director Frolik noted that the Council has until March 12, 2001, to <br />take action on preliminary plat. <br /> <br />City Attorney Goodrich stated that the City Council could grant preliminary plat approval <br />contingent upon entering into a development agreement. <br /> <br />City Council/February 13, 2001 <br /> Page 25 of 28 <br /> <br /> <br />
