CC Regular Session <br />Meeting Date: 09/22/2020 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />Information <br />5. 12. <br />Title <br />Adopt Resolution #20-199 Approving an Amended and Restated Development Agreement between the City of <br />Ramsey and Rum River Prairie, LLC <br />Purpose/Background: <br />The purpose of this case is to consider a proposed amended development agreement between the City and Rum <br />River Prairie LLC (Applicant). With the original development agreement the Applicant intended to construct a trail <br />along the north side of Highway 47 and the City was going to provide credit to park and trail fees to cover the costs <br />associated with the construction of that trail. The Applicant has now indicated a preference for having the City <br />construct the trail which City Staff is supportive of. The amended development agreement removes language <br />related to crediting trail and park dedication dollars as well as the city purchasing construction plans from the <br />Applicant for the trail at a cost of $5,000.00 <br />Notification: <br />Notification is not required for this request. <br />Observations/Alternatives: <br />Observations <br />At the time this development was originally approved the developer was going to construct a segment of trail along <br />Armstrong Boulevard between Tiger St NW and 173rd Ave NW. The developer has run into issues related to <br />coordination with Anoka County and wetland impacts. With the original agreement the City was going to credit <br />back the Developer the cost to construct the trail from development fees paid associated with park and trail <br />dedication dollars. City Staff believes that based on the issues that have arisen that City Staff is better equipped to <br />work through the trail construction in coordination with Anoka County. The Developer did have LHB, inc create <br />construction plans for the trail which cost a fee of $5,000.00 to complete which the Developer is asking the City to <br />purchase from him at the same cost of $5,000.00. Staff believes this request is reasonable and the City will utilize <br />these plans in coordination with Anoka County for the trail construction. <br />Alternatives <br />Alternative 1: Adopt Resolution #20-199 Approving the proposed resolution which would amend the development <br />agreement. The proposed amendment is related to the construction of a trail along Armstrong Boulevard that the <br />Applicant was going to construct and be credited for the cost to do so, but as drafted the City would now construct <br />that trail and no credit would be provided to the developer. Staff supports this alternative and believes it will be <br />smoother if the City completes the project in coordination with Anoka County. <br />Alternative 2: Do not adopt Resolution #20-199 Approving the proposed resolution amended the existing <br />development agreement. Staff does not support this alternative. <br />Funding Source: <br />Staff is handling this case as part of normal staff duties. <br />
