<br />Councilmember Riley introduced the following resolution and moved for its adoption: <br />RESOLUTION #20-199 <br />RESOLUTION APPROVING RELEASE OF CERTAIN TERMS OF THE <br />DEVELOPMENT CONTRACT FOR RUM RIVER PRAIRE SUBDIVISON. <br /> <br />WHEREAS, the City of Ramsey, herein referred to as the “City,” has approved a <br />development contract for the residential development generally known as Rum River Prairie and <br />legally described in Exhibit A (the “Subject Property”); and <br /> <br />WHEREAS, the Subject Property is hereby released from the terms and conditions, <br />listed in Exhibit B Section 3 of the Development Contract. The remainder of the Development <br />Contract shall survive this Termination and Release of Certain Terms of the Development <br />Contract, of that certain Development Contract for Rum River Prairie Subdivision dated June <br />12, 2018, filed June 15, 2018 as Document No. 2201861.004; and <br /> <br /> WHEREAS, the City will now be developing the trail associated with the Plat and the City <br />will be purchasing the trail construction plans from the Developer at a cost of $5,000.00 and the <br />City will not be providing any credit to development fees that would have been provided as a result <br />of the trail construction. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City, subject to City Attorney review, approves: <br /> <br />a. Release from the terms and conditions listed under Exhibit B, item 3 of the <br />Development Contract for Rum River Prairie Subdivision dated June 12, 2018, as <br />Anoka County Document Number No. 2201861.004. <br /> <br />That the motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Kuzma, and upon vote being taken thereon, the following voted in favor: <br /> <br /> Mayor LeTourneau <br /> Councilmember Riley <br /> Councilmember Kuzma <br /> Councilmember Menth <br /> Councilmember Musgrove <br /> Councilmember Specht <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br /> <br /> <br />
