Councilmember Hendriksen expressed concern that the City Attorney reads the law very strictly <br />in one area and very stringently in other area. He also stated that the petition was circulated with <br />the full text of the proposed Charter Amendment. <br /> <br />City Attorney Goodrich stated that he did not agree with Councilmember Hendriksen's opinion. <br /> <br />Councilmember Hendriksen requested more information on the case Housing and <br />Redevelopment Authority of Minneapolis vs. City of Minneapolis. <br /> <br />City Attorney Goodrich reviewed the history of the case. <br /> <br />Councilmember Hendriksen stated that he does not want to be responsible for bringing <br />something forward that is found not to comply with State law and if he has some disappointment <br />it is that they find themselves at this juncture. The City Attorney had this wording for sometime <br />during circulation and these issues were never brought up, even though he had many <br />conversations with the City Attorney. He explained that he has every intention of making the <br />two word change and moving the petition forward. He stated that he does disagree with the City <br />Attorney's interpretation of State Statute 410.20, but he does agree with the City Attorney's <br />second portion of his opinion and worries that the true motivation is that there was a desire to <br />very strictly read State law in order to find problems to prevent the amendment from reaching the <br />ballot. <br /> <br />City Attorney Goodrich noted that the first time he reviewed the petition was when it was <br />presented to the City, even though the Council gave him the authority to review the petition <br />before distribution. If it had been brought to him prior to circulation he would have given him <br />the information. He sated that State Law should be sited as part of the petition circulation. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to receive the <br />City Attorney opinion dated February 23, 2001. <br /> <br />Further discussion: Councilmember Zimmerman inquired if the two words that were in error <br />were "Any Action". City Attorney Goodrich replied yes. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Councilmember Hendriksen inquired if the City Attorney would review the petition prior to its <br />circulation. <br /> <br />Mayor Gamec stated that if the City Attorney reviews the petition prior to circulation then the <br />City Attorney is working on two sides. <br /> <br />Councilmember Hendriksen replied that the City Attorney would only be reviewing the <br />document and determining if it is legal. <br /> <br />City Council/February 27, 2001 <br /> Page 17 of 23 <br /> <br /> <br />
