Councilmember Hendrikgen noted that gomeone could not meet the conditiong o£ the conditional <br />use permit if they owned only part of thc property. <br /> <br />City Attorney Goodrich explained that the conditions in the conditional use permit, that have <br />been agreed upon, are unique to the property. Item #4 of the Conditional Use Permit states that <br />the number of horses would have to be reduced if the land is no longer leased. <br /> <br />Mayor Gamec inquired if it was possible to include in the Conditional Use Permit that the permit <br />goes with the property owner not the land. <br /> <br />Community Development Director Frolik explained that the City has done so on occasion with <br />home occupations. <br /> <br />City Attorney Goodrich noted that State Statute prescribes that conditional use permits run with <br />the land. <br /> <br />Councilmember Hendriksen stated that if the permit is operated within the terms agreed upon <br />then the Conditional Use Permit is valid. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution <br />#01-02-145 adopting Findings of Fact # 0547 relating to a request from Theresa Dahlheimer for <br />a conditional use permit to maintain four horses on property that includes 2.5 acres of owned <br />property and four acres of leased land. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#01-02-146 approving the issuance of a conditional use permit, based on the Findings of Fact, to <br />Theresa Dahlheimer to maintain four horses on property that includes 2.5 acres of owned <br />property and four acres of leased land, and declaring terms of permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />John Enstrom, 8702 - 181st Avenue NW, Ramsey, stated that he feels that letting horses run on <br />the property is a travesty to the City. He and two of his other neighbors are opposed to the <br />request. The property that Ms. Dahlheimer is leasing is full of quick sand and is not safe for the <br />horses. There are no fences connecting the two properties. The Dahlheimers have never had a <br />good system of disposing of animal waste. They dispose of waste in the front of their yard and <br />that should not be tolerated.
