Section 3.08 Conditional Redemption of Bonds. Notwithstanding any provisions in this <br />Article III to the contrary, the Issuer may condition redemption of Bonds on receipt of sufficient <br />monies no later than the Business Day next preceding the redemption date. This condition shall <br />be stated in the notice of redemption, and if for any reason the monies are not received by such <br />Business Day, the redemption shall be automatically cancelled, interest shall continue to accrue <br />and be entitled to the benefits of this Indenture on and after the date on which the Bonds were to <br />be redeemed and the Trustee shall promptlymail notice of said cancellation by first class mail to <br />the Holders of all Bonds which were to be redeemed, at their last address appearing upon the <br />Bond Register, and return to said Holders any Bonds surrendered by them for said redemption. <br /> <br />94 <br /> <br />1763903vl <br /> <br /> <br />
