pay, or to reimburse the Landlord or Tenant, as the case may be, for payments made, for the
<br />t'bllo,,ving costs and for the following purposes:
<br />
<br /> (l) All Project Costs, including the costs of acquihng, constructing, and equipping
<br />the Project, including costs of labor and materials and other charges fi.om architects, engineers,
<br />contractors, builders and material suppliers in connection with the design, plarmSng, acquisition,
<br />installation and construction of the Project, and including the reasonable expenses of any
<br />employees of the Tenant performing any such functions (provided said employee costs are
<br />properly chargeable as a capital Cost of the Project);
<br />
<br /> (2) Interest accruing upon the Ser/es 2005A Bonds prior to the Completion Date and
<br />not covered by proceeds of the Series 2005A Bonds and earnings thereon deposited in the Bond
<br />Fuad, and any interest which has accrued for.any interim f'mancing obtained by the Tenant
<br />incident to the acquisition, installation and construction of the Project before the Series 2005A
<br />Bonds axe delivered to the initial purchaser thereof;
<br />
<br /> (3) The cost of any indemnity and surety bonds obtained in connection with the
<br />l'rojccr, the fees and expenses of the Trustee during construction, taxes and other municipal
<br />goYernmental charges levied or assessed during construction upon the Project or any property
<br />acquired therefor, and the premiums for insurance, if any, in connection with the Project during
<br />c~) nztruction;
<br />
<br /> (4) The cost of acquisition and installation of equipment for completion or operation
<br />thc Project;
<br />
<br /> (5) Fees and expenses of engineers and archkects for surveys and estimates and other
<br />preiinfinary investigations, preparation of plans and specifications, and supervising acquisition,
<br />installation and construction, as well as for the performance of all other duties of engineers and
<br />architects, as are specifically required in relation to the acquisition, installation and construction
<br />o~' the Project or the issuance of Bonds therefor;
<br />
<br /> (6) Expenses o'f administration, supervision and inSpectiOn properly chargeable to the
<br />Project, any administrative fees of the Landlord, legal expenses and fees, fiscal consultant
<br />expenses and fees, financing charges, cost of~.a. Udits and of preparing, offering and issuing the
<br />Bon&,, and initial and transaction fees and any expenses of the Trustee, incident to the
<br />acquisition, installation, construction and financing of the Project; and also
<br />
<br /> (7) Any other obligation or expense heretofore or hereafter incurred by the Landlord
<br />or the Tenant in connection with the acquisition, installation, equipping and construction of the
<br />Project.
<br />
<br /> All moneys in the Construction Fund (including moneys earned, pursuant'to the .
<br />provisions of Section 3.8) remaining after the Co. mpletion Date and payment in full of the items
<br />provided for in the preceding subsections (1) to (7), inclusive, of this section, then due and
<br />payable, shall be deposited in the Bond Fund, as provided in the Indenture, and credited against
<br />amounts of Rental Payments due or to become due; provided that mounts approved, by the
<br />r['e~ax~t Representative, as to Project Costs, shall.be retained by the Trustee in the Construction
<br />l~'un.d for payment of Project Costs not then due and payable but reasonably foreseen.
