ARTICLE IX <br /> <br />PROJECT WARRANTIES <br /> <br /> Section 9.1. Selection of Proiect. The Project and the Contractors have been and are to <br />be selected by Tenant, and Landlord shall have no responsibility in connect[on therewith, or with <br />respect to the suitabilitY of the Project for the use intended by Tenant or any delay or failure by <br />the Contractors to construct the Project for use by Tenant. <br /> <br /> Section 9.2. Construction and Maintenance of Project. Landlord shall have no <br />obligation to construct, inspect or maintain the Project or any portion thereof under any <br />circumstances, but such actions shall be the obligation of Tenant. <br /> <br /> Section 9.3. Contractors' Warranties. Laridlord hereby assigns to'Tenant for and <br />during the Term of this Lease, all of its interest in all Contractors' warranties and guarantees, <br />express or implied, issued on or applicable to the Project, and Landlord hereby authorizes Tenant <br />to obtain the customary services furnished in connection with such warranties and guarantees at <br />Tenant's expense. <br /> <br /> Section 9.4. Disclaimer of Warranties. THE PROJECT IS LEASED TO TENANT <br />HEP, Y;[YNDER AS IS, AND LANDLORD MAKES NO WARRANTY' OR <br />REPR£SENTATION, EITHER EXPRESS OR ~MPLIED, AS TO THE VALUE, DESIGN, <br />CONDITION, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR <br />Fi.
