Land by any person or entity, however organized (other than Lessee or any assignee of <br /> <br /> Section 3.05 Environmental Matters. Lessor will hold Lessee harmless fi.om and <br />indemnif~j and defend Lessee against any claims brought by any party involving any <br />e;~viromnental condition of the Land. The term "claim" shall include remediation costs, damage <br />cr~:gts, ~ines, penalties, Forfeitures, administrative costs, consent agreements and order, attorneys' <br /> consultant fees and laboratory fees. <br /> <br />ARTICLE IV <br /> <br />LESSEE'S DEFAULT; REMED~S <br /> <br /> Section 4.01 Lessee's Default. The following shall be an "event of default" or a <br />"de£a~.dt" hereunder: if Lessee shall fail to ii) pay the rent provided herein~ er (ii) observe or <br />per.form any of the obligations of Lessee otherwise provided herein. <br /> <br /> Section 4.02 Lessor's Remedies. Upon the occurrence of an event of default by Lessee <br />hereunder, which shall remain Uncured for thirty days after receipt by Lessee of written notice of <br />s~mh event ot' default, Lessor may thereafter or any time subsequently during the existence of <br />such breach or default; ii) enter into and upon the Land and/-epossess the same, expelling and <br />removing therefrom all persons and property, and (ii) terminate this Ground Lease, holding . <br />Lessee liable for damages for its breach. <br /> <br />ARTICLE V <br /> <br />BINDING EFFECT; SUCCESSORS AND ASSIGNS <br /> <br /> Section 5.0 l Binding Effect. Tkis Ground Lease shall be binding upon, and inure t° the <br />benefit of, the parties hereto, and their successors and assigns. <br /> <br /> Section 5.02 Applicable Law.
