The grading and drainage plan will need to be revised in accordance with the staffreview letter.

The property contains several wetlands. The developer has agreed to establish a "No Mow" zone along
the wetlands. This will help future residents to know where they need to stop establishing a manicured
lawn. Si:aft' is also requesting that the developer plant appropriate seeding specifications within a portion
t>t' the no mow zone to further establish and protect the wetland areas. ·

The proposed plat was reviewed for park dedication and trail requirements by the Park Commission at
their April. 14, 2005 meeting. The Park Commission recommended that park dedication and trail fees be
satisfied through a cash payment. The preliminary plat is providing a bituminous trail along County
Road 5 and is providing a pedestrian connection within the plat from Quicksilver Circle to the proposed
trail along County Road 5. The proposed trail configuration complies with the desires and
recommendation established by the Park and Recreation Commission.

The Planning Commission held a public hearing and reviewed the preliminary plat and site plan on April
7, 2005. During the public hearing, several residents stated their opposition to the propOsed
development.

Planning Commission Recommendation:

The Planning Commission was relatively split on this development. A motion was made to approve the
preliminary plat and site plan with a couple contingencies related to compliance with the staff review
letter and resolution of Potassium Street. T-he vote failed .one a 3:3 vote. A second attempt at. a motion
was made to deny the preliminary plat and site plan based on inappropriate use of PUD, utilization of the
~.ownhomes, Potassium Street issue unresolved, and crowding of townhouse units 1-14. The motion
passed, on a 3:2 vote with I member abstention.

Observations Continued:

Subsequent to the Planning Commission meeting, the applicant, City Staff, and the City Attorney met to
discuss the outstanding issue of Potassium Street. Staff asked Shade Tree to look at ways to shift
Potassium Street to the west. They submitted a revised site plan that shows the road being shifted along
their property line and then providing a 25 foot easement solely within their property to allow for
adequate snow storage area. Generally speaking, this would allow the ability to save a significant amount
of trees that would have otherwise been removed to facilitate the construction of Potassium Street down
the center of the 60 foot right of way.

On May 10, 2005, the City Council reviewed and tabled action 'on the plat and site plan due to
tmres(2lved issues related to Potassium Street. The City Council directed staff to attempt to contact the
property owners affected by the acquisition of right-of-way to upgrade Potassium Street. The property
owners are Terry and Mary Lamont, David and Jean Mott, and Milt Weichelt. Staff sent letters to the
property owners and attempted to make direct contact with each owner. Mr. Mott is out of town for a
week due to a family emergency, Milt is out of town until May 20th, and staff left a voice mail message
with the Lamont's. Staff will verbally report any Updates at the meeting.

Thc City Council also directed staff to begin working on cost estimates and intersection upgrade options
fiJr both. the south and north Old County Road 5 accesses. Engineering will verbally report any
preliminary information at the meeting.

-107-
