Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-05- <br /> <br />A RESOLUTION GRANTING CONTINGENT PRELIMINARY PLAT APPROVAL <br />FOR THE PLAT OF RUM RIVER ESTATES. <br /> <br /> WHEREAS, National Growth, LLC, a Minnesota limited liability company hereinafter <br />referred to as "Developer", has properly applied for preliminary plat approval of a subdivision to <br />be known as Rum River Estates Addition on the following described property located in the City <br />of Ramsey: <br /> <br />The north 330.00 feet of the Northwest Quarter of the Northeast Quarter of Section 23, <br />Township 32, Range 25, together with an easement for road purposes over the west <br />33.00 feet. of that part of the Northeast Quarter of said Section 23- which lies north of <br />County State Aid Highway No. 5, -according to the United States Government survey <br />thereof, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br /> WHEREAS, on December i3, 2004, the City of Ramsey received an application and <br />sketch plan from Developrer for a subdivision to be named Rum River Estates (the "Plat"); and <br /> <br /> WHEREAS, on January 6, 2005, the Planning Commission reviewed the sketch plan for <br />the Plat; and <br /> <br />WHEREAS, on January 25, 2005, the City Council reviewed the sketch plan for the Plat; <br /> <br />and <br /> <br /> WHEREAS, on FebrUary 11, 2005, the Developer submitted a Preliminary plat for the <br />Plat for consideration; and <br /> <br /> WHEREAS, on April 7, 2005, the Planning CommissiOn conducted a public hearing and <br />recommended the City Council deny the preliminary Plat; and <br /> <br /> WHEREAS, on April 14, 2005, the Park and Recreation Commission recommended <br />park dedication and trail fees for the Plat be satisfied through a cash paYment; and <br /> <br /> WHEREAS, the primary access to the Plat is to be via Potassium Street NW lying to the <br />east of the Plat; and <br /> <br /> WHEREAS, Potassium Street is dedicated to the City by statutory dedication as a result <br />of it having been in continuous public use and maintained by the City over a continuous six year <br />period; and <br /> <br />-186- <br /> <br /> <br />
