2. JVarrower lot widths for urban single-family lots. Current regulations require lots to be at
least 80 feet wide at the front-yard setback line. The proposed development shows lot widths
at 46 feet and 64 feet.
3. Reduced building setbacks. The development is proposing a 25 foot front yard setback, City
Code establishes a 30 foot front yard setback.
4. Public Street exceeding length requirement: The preliminary plat is showing a public street
that exceeds 600 feet in length. The property does not lend itself to provide a connection to
existing streets or to provide two accesses from Potassium Street..

The PUD ordinance states that the developments should provide 20% public open .space or 50%
private open space area. The development shows 59 % private open space.

The Planning Commission held the public heating and reviewed the rezoning request at their
ApriI 7, 2005 meeting. Subsequent to the meeting, staff came across a section in City Code that
requires developments proposing townhouses within the R~I District to be reviewed under the R-
2 standards when processed through a PUD.. In lieu of this information; .the above four deviations
have been modified to the following two:
1) Providing a public street that is 1,005 feet in length, which exceeds the City's
600 foot cul-de-sac length by 405 feet.
2) Reduced structure to structure setback from 20 feet to 15 feet

Recommendation:

The Planning Commission recommended that the City Council deny the rezoning based on
findings of fact, which are attached to this case. In general the Planning Commission could not
support the rezoning for the following reasons:

1. Density is too high
2. Proposed cul-de-sac is to long without a potential future connection
3. Ownership issue of Potassium Street is not resolved
4. Overall not comfortable with the proposed deviations

Staff has attached a copy of the original boilerplate findings that was presented to the Planning
Commission for the purpose of allowing the City Council to see what changes were made by the
Planning Commission and to update the findings to reflect the correct deviations.

The City Council tabled this case due to unresolved Potassium Street issues.

Council Action:

Motion to approve Resolution # adopting Findings of Fact
applicant and denying the rezoning request.

not favorable to the

-orr

Motion to adopt Resolution #
applicant.

approving Findings of Fact

favorable to the

-196-
