Councilmcmber introduced the following reso}ution and moved for its adoption: <br /> <br />RESOLUTION # 05-05- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />JAMES AND CHERI WALLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE <br />ALl,OWED FOR ACCESSORY BUILDINGS BASED ON FINDINGS OF FACT # AND <br />D ~;CLARING TERMS OF SAME: <br /> <br /> WHEREAS, James and Cheri Waller (Permittees) have properly applied for a conditional <br />t~,'-ge permit to exceed the maximum square footage allowed for accessory buildings for properties <br />between 14,880 and 43,559 square feet as established in section 9.11.02 "Accessory Uses" of City <br />~)~de on the property generally known as 17937 Fluorine St NW and legally described as follows: <br /> <br />Lot 5, Block 7, Ford Brook Estates, Anoka County, Minnesota <br /> <br />(S ubj ect Property) <br /> <br /> WHEREAS, the Planning Commission met on May 5, 2005, conducted the public <br />hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a conditional use permit (Permit) to exceed the maximum <br />allowable square footage for accessory building space on properties between 14,880 and 43,559 <br />square feet in size, is hereby granted to James and Cheri Waller, hereinafter referred to as the <br /> I crm~ttees , <br /> <br />That the overall square fbotage for accessory buildings may exceed the 1,488 square foot <br />accessory building size restriction for properties between the size of 14,880 and 43,559 square <br />fket by a total of 160 feet in order to accommodate the inside storage of private-use equipment <br />and vehicles. <br /> <br />That the maximum allowable height of the sidewalls is restricted to ten (10) feet and the overall <br />mean gable height is restricted to sixteen (165 feet. <br /> <br />~'l, That the construction of the detached accessory building on the Subject. Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />~i. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable MN State Building Codes. <br /> <br />6. 'l'hc Permittees herein agree that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />8. 'f'hat tt~e Pennittee shall be responsible f0~'.,all City costs incurred in administering and enforcing <br /> this Permit. <br /> <br />-309- <br /> <br /> <br />
