S. 3021-61 <br />SEC. 1321. FARGO-MOORHEAD METROPOLITAN AREA DIVERSION <br />PROJECT, NORTH DAKOTA. <br />(a) EXEMPTION. —Subject to subsections (b) and (c), notwith- <br />standing section 404(b)(2)(B)(ii) of the Robert T. Stafford Disaster <br />Relief and Emergency Assistance Act (42 U.S.C. 5170c(b)(2)(B)(ii)), <br />and any regulations promulgated to carry out that section, begin- <br />ning on the date of enactment of this Act, any property in the <br />State of North Dakota that was acquired through hazard mitigation <br />assistance provided under section 203 of that Act (42 U.S.C. 5133), <br />section 404 of that Act (42 U.S.C. 5170c), or section 1366 of the <br />National Flood Insurance Act of 1968 (42 U.S.C. 4104c), that was <br />subject to any open space deed restriction is exempt from those <br />restrictions to the extent necessary to complete the Fargo -Moorhead <br />Metropolitan Area Diversion Project authorized by section 7002(2) <br />of the Water Resources Reform and Development Act of 2014 (128 <br />Stat. 1366). <br />(b) CONDITIONS. —As a condition of the exemption under sub- <br />section (a)— <br />(1) no new or additional structure unrelated to the Project <br />may be erected on the property unless the new or additional <br />structure is in compliance with section 404(b)(2)(B)(ii) of the <br />Robert T. Stafford Disaster Relief and Emergency Assistance <br />Act (42 U.S.C. 5170c(b)(2)(B)(ii)); and <br />(2) any subsequent use of the land on the property that <br />is unrelated to the Project shall comply with that section. <br />(c) DISASTER ASSISTANCE PROHIBITED. —After the date of enact- <br />ment of this Act, no disaster assistance from any Federal source <br />may be provided with respect to any improvements made on the <br />property referred to in subsection (a). <br />(d) SAVINGS PROVISION. —Nothing in this section affects the <br />responsibility of any entity to comply with all other applicable <br />laws (including regulations) with respect to the properties described <br />in subsection (a). <br />SEC. 1322. CLATSOP COUNTY, OREGON. <br />The portions of the project for raising and improving existing <br />levees of Clatsop County Diking District No. 13, in Clatsop County, <br />Oregon, authorized by section 5 of the Act of June 22, 1936 (49 <br />Stat. 1590), that are referred to as Christensen No. 1 Dike No. <br />42 and Christensen No. 2 Levee No. 43 are no longer authorized <br />beginning on the date of enactment of this Act. <br />SEC. 1323. SVENSEN ISLAND, OREGON. <br />The project for flood risk management, Svensen Island, Oregon, <br />authorized by section 204 of the Flood Control Act of 1950 (64 <br />Stat. 180), is no longer authorized beginning on the date of enact- <br />ment of this Act. <br />SEC. 1324.
