CC Regular Session <br />Meeting Date: 10/13/2020 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />Information <br />5. 8. <br />Title: <br />Adopt Resolution #20-198 Approving Easement Encroachments for 6043 Highway 10 NW; Case of Roman <br />Gadaskin <br />Purpose/Background: <br />The purpose of this case is to update the City Council on activities relating to 6043 Highway 10 NW and 6021 <br />Highway 10 NW (former ICO gas station). The Property Owner has been working to make improvements to the <br />industrial building at 6043 Highway 10, specifically the placement of a new ramp for the loading dock. This did <br />result in the encroachment onto drainage and utility easements that contain subgrade utilities. The ramp is <br />removable in the event of an emergency, so this encroachment has been contemplated previously. The Easement <br />Encroachment Agreement allows a legal tool that is commonly used by the City. <br />Notification: <br />No notifications required at this time. <br />Observations/Alternatives: <br />Currently both City Water and Sanitary Sewer utilities extend north/south between the properties 6043 and 6021 <br />Highway 10 NW. City sewer then extends west underneath the building at 6043 Highway 10 NW. Previously, no <br />drainage and utility easements existed over the water/sewer lines within these properties. <br />The Property Owner has granted the City a drainage and utility easement over those utilities at no cost to the City. <br />The cost included the Property Owner paid for the drafting of the drainage and utility easement itself and has <br />officially recorded that easement with Anoka County. <br />Current tenants at 6043 Highway 10 NW were approved for improved ramps adjacent to overhead doors. <br />Previously, there was a dirt ramp and deteriorating concrete platform that were removed from the site and replaced <br />with a new ramp and concrete platform. The property owner is proposing to add an additional moveable metal ramp <br />that would match the ramp currently on site. The ramps will extend into the newly granted drainage and utility <br />easement and thus requires an encroachment agreement. Staff is supportive of this solution as the metal ramps are <br />able to be more easily moved compared to a traditional poured concrete ramp if any future maintenance is required <br />for either the water or sewer utilities. <br />Staff believes that the ramps would be an aesthetic improvement and assist in the City's effort to clean up the image <br />of the Highway 10 corridor. <br />Alternative 1: Adopt Resolution #20-198 approving an easement encroachment for 6043 Highway 10 NW. The <br />Property owner granted the easements to the City and Staff believes the moveable ramps are a suitable compromise <br />to allow for future utility maintenance while still supporting the day to day operations of the site for commercial <br />use. Staff supports this alternative. <br />Funding Source: <br />Staff handles requests like this as part of their normal duties. <br />
