CC Regular Session 5. 14. <br />Meeting Date: 10/27/2020 <br />By: Chloe McGuire Brigl, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #20-252 Approving Abatement for 5344 142nd Cir NW <br />Purpose/Background: <br />The purpose of this case is to authorize an abatement for 5344 142nd Cir NW for general nuisance items in the rear <br />yard including a large pile of firewood, tree branches, leaves, and other debris. The property has received numerous <br />complaints, and is in violation of Chapter 30 of the City Code as well as the International Property Maintenance <br />Code. <br />Notification: <br />The Property Owner was notified of this meeting. No public notice is required. <br />Observations/Alternatives: <br />City Staff has sent four notices of violation, three citations, and an abatement notice. Per standard Code <br />Enforcement process, Property Owners receive a first notice of violation and two weeks to remedy the issue. Then a <br />second notice of violation is sent with a citation and another two weeks. City Staff has been told by the Property <br />Owner more than once that the pile would be removed, but has not seen progress onsite. Notices are attached with <br />the first being sent in August 2020. <br />In terms of abatement, this is a generally small abatement and will not take much time from the City's Abatement <br />Contractor. The Property Owner is charged for the abatement plus an administrative cost. Ideally, the Property <br />Owner would clean up the site prior to the abatement date. The Property Owner has approximately one week from <br />the date of this meeting (2 weeks from date letter was sent) to clean up the Property before City Staff will schedule <br />an abatement. Staff is requesting this abatement at this time due to the recent change in weather. If not removed <br />soon, the items will freeze and will be significantly harder, and more expensive, to remove - if it's even possible to <br />remove. <br />Funding Source: <br />Staff handles Code Enforcement as part of regular duties. <br />Recommendation: <br />Staff Recommends the City Council Adopt Resolution #20-252 Approving Abatement for 5344 142nd Cir NW <br />Action: <br />Motion to Adopt Resolution #20-252 Approving Abatement for 5344 142nd Cir NW <br />Attachments <br />Subject location <br />First Notice of Violation <br />
