City Attorney Goodrich ~ugge~ted tabling action, which would allow the Council time to view
the property and also give him the opportunity to discuss the legal ramifications on the purchase
agreement.

Councilmember Hendriksen stated that it is clear that St. Paul Terminals does not want the
existing conditional use permit and the City does not want the current use of the property to
continue. He stated that he would be willing to grant some type of conditional use permit in
exchange for an improved site.

City Attorney Goodrich noted that the only purpose the conditional use permit would need to be
reassigned was for purchase agreement purposes. Reassigning the conditional use permit does
not put the City in a different position than what currently exists.

Jim Gilbertson, 17930 Ermine Boulevard NW, Ramsey, inquired as to what the City was
negotiating with Danny's Tranny and why they are changing the rules. The City should be
taking in tax dollars rather than giving land away.

Mr. Martinson replied that St. Paul Terminals is not asking the Council anything for free. They
are willing to comply with the terms of the conditional use permit as it is written. The City came
to St. Paul Terminals asking for some type of concession regarding the extension of 141st Street,
but without a conditional use permit they do not own the property.

Mayor Gamec suggested tabling action until the next City Council meeting.

Kristine Boline, Attorney representing Danny's Trannys, inquired if the Council would consider
an interim assignment of the conditional use permit so that the sale of the property could
continue.

Mayor Gamec recommended having all parties involved meet with the City Attorney to work out
the details.

Motion by Councilmember Anderson, seconded by Councilmember Kurak, to table action until
the next regular City Council meeting.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen,
and Zimmerman. Voting No: None.

Case #4:

Receive Quotes for the Removal of Concrete Rubble and Miscellaneous
Debris on Makens Property

City Engineer Olson stated that the construction of 143rd Avenue NW between Jasper Street NW
and C.R. #116 started early this spring and will continue and be completed by the end of the
summer. During the construction of the facilities that would enable development to occur in

City Council/May 8, 2001
