Record ID 1544135 <br /> <br />482309.010 <br /> <br />(',hairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-12-360 <br /> <br />A RES()I,UTION APPROVING THE ISSUANCE OF A VARIANCE TO THE <br />MAXIMUM FRONT YARD SETBACK FOR THE PROPOSED POND BUILDING IN <br />'File TOWN CENTER ZONING DISTRICT, SUBDISTRICT TC-2.AND DECLARING <br />TERMS OF SAME. <br /> <br /> WltEREAS, RAMDANCE, LLC, hereinafter referred to as "Applicant," has properly <br />applied f(>r a variance fi'om Section 9.20.25(3)(b) regarding maximum front yard setbacks in the <br />TC-2 Sub-l)istrict of the Town Center District, on the property legally described as follows: <br /> <br />Outlet 1, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Propcrty); <br /> <br />upon recording: <br /> <br />Block 1, Ramsey Town Center 3rd Addition <br /> <br />0he "Subj ect Property") <br /> <br /> WHEREAS, the Board of Adjustment met on December 2, 2004, conducted the public <br />hearing and adopted Findings of Fact relating to the Applicant's request for a variance from the <br />m ax ira um front yard setback requirements as part of the development of the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Resolution #04-12-359 adopting Findings of Fact #0710, a variance to the <br />maximum fi'ont yard setback, as established in Section 9.20.25(3)(b) of the Ramsey City <br />(.!ode, is approved for the development of a multi-tenant restaurant building (the "Pond <br />Building") on the Subject Property. <br /> <br />rFhat the placement of the Pond Building shall generally be in accordance with the <br />Preliminary Site Plan prepared by URS dated November 10, 2004. <br /> <br />'Ibc Pcrmittee shall be responsible for all City costs incurred in processing the variance <br />roc]klost. <br /> <br /> <br />
