Record ID 1532549 <br /> <br />1973667.003 <br /> <br /> 3¢ -sA. <br />l loard Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-02-034 <br /> <br />A RESOLUTION DECLARING TERMS OF A VARIANCE TO THE MINIMUM LOT <br />WIDTH AND LOT AREA IN THE CRITICAL RIVER OVERLAY DISTRICT. <br /> <br /> WHEREAS, on February 3, 2005, the Ramsey Board of Adjustment issued a variance <br />f~'om Section 9.21.07 of the Ramsey City Code which allows for substandard lot size and width <br />on tiao property legally described as follows: <br /> <br />l Jot 1 Block 1 Bowers Mississippi Acres 2nd Addition TOG/W Lot 33 Bowers Mississippi <br />Acres, Anoka County, Minnesota <br /> <br />OF <br /> <br /> (the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />TIlE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0715, a variance to lot width and lot area is hereby granted in to <br />rcnder Lot I Block 1 Bowers Mississippi Acres 2"d Addition a buildable lot. <br /> <br />That l,ot 1 Block 1 Bowers Mississippi Acres 2nd Addition and Lot 33 Bowers Mississippi <br />Acres ;vill be .97 and .95 in size respectively, and each will be 100 feet in width. <br /> <br />q'hat Lot 1 Block 1 Bowers Mississippi Acres 2nd Addition will not be eligible for a building <br />permit until such time as Anoka County has assigned a separate Parcel Identification Number <br />(PIN). <br /> <br />That the Applicant, or future owner, is subject to the Building Permit process and must <br />comply with all International Building Code requirements at such time that a new dwelling is <br />constructed. <br /> <br />qhat at such time when construction of a new dwelling occurs, the Applicant, or future <br />owncr, shall adhere to the Department of Natural Resource's suggested actions as outlined in <br />thc letter dated January 21, 2005 to help mitigate the impacts of construction. <br /> <br />6. That thc Applicant, or future owner, is subject to applicable regulations in the Critical River <br /> Overlay District and the underlying zoning regulations. <br /> <br />7. q'hat thc Applicant shall be responsible for all City costs incurred in administering and <br /> enibrcing this variance. <br /> <br /> <br />
