He stated the City does not need an ordinance to do what they need to <br /> <br />Mr. Gordon indicated the wetland conservation act puts everyone .on notice that if there is a <br />wetland tlnere are certain things you need to do. ' <br /> <br />Commissioner Johnson indicated if the ordinance says any property undertaking development in <br />the city has to comply with the ordinance it would be better. <br /> <br />Mr. Gordon stated that is what the ordinance says. <br /> <br />C~m~mi s.~;ioner Johnson indicated it needs to be more straightforward. <br /> <br />Chairpcrsoi~ Nixt commented that he assumes they will cross-reference this with the subdivision <br />and zoning ordinances. <br /> <br />Gordon agreed that it would be, and it states that in 9.26.05. <br /> <br />Commis.sioner Johnson commented that it does not say if you are subdividing a lot after this <br />ordinance is in effect you have to submit this information. <br /> <br />Mr. (}ordon stated that is almost too basic; you have to do it according to the Wetland <br />Conservation Act. <br /> <br />Chairpe, rson Nixt agreed it needs to be said, specifying after the effective date of the ordinance. <br /> stated what this will leave out is platted lots with no currently building permit. <br /> <br />Mr. Gordon indicated there are triggered events where il~is would go into effect, and would <br />inc]m_tc platted lots that have not been developed. He stated this goes down to the level of <br />grading, so if' you need a grading pe.rmit you would have to get a wetland evaluation.. He added <br />dmt i,s really the only retroactive trigger for lots of record. He stated trying to do this <br />retroactively on lots created five years ago is challenging. He indicated the Environmental'Policy <br />ri'ask Fc~rce proposed an educational process to teach those landowners the implications of <br />d~:veiopmcnt. <br /> <br />Chairpcr,';on Nixt called for a short recess at 9:43 p.m. The meeting resumed at 9:47 p.m. <br /> <br />Commissioner Johnson asked if section 9.26.02 Subd 2 is necessary. <br /> <br />'vir.
