CASE # 3 <br /> <br /> PUBLIC HEARING <br />REQUEST FOR COMPREHENSIVE PLAN AMENDMENT <br />FOR THE PROPOSED PLAT OF MARIGOLD POND; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />()~_kwr>,M Land Development has submitted an application for an amendment to the 2001 <br />(2ompr'ehcnsive Plan. The request is to change the land use designation from Rural Developing to <br />I,ow Density Residential on the property on the east side of Highway 47, north of the Boy Scout <br />(;amp. Staff attempted to notify property owners within 700 feet of <br />th~ subject property. <br /> <br />()bservations: <br /> <br />('.lakwood Land Development is proposing to extend sanitary sewer and municipal water to the <br />~,;ubjcci. property, located in the R-1 Residential- Rural Developing District. The preliminary plat <br />i.~; proposing to develop the property with single family homes at urban densities. The 2001 <br />Comprehensive Plan designates the subject property as Rural Developing. Development of <br />Marigold Pond with urban smwices requires a Comprehensive Plan Amendment to change the <br />:.;~l)j,,:ct pt'operty's land use designation from Rural Developing to Low Density Residential. <br /> <br />(_m /\pti/ ?,6, 2005, the City Council adopted an Interim Policy for proposed land use changes <br />~lmt ar~ rt:quested prior to the completion of the Comprehensive Plan update later this year. The <br />i~]terim policy reads as follows, with Staff comments in italics: <br /> <br />I. Thc proposed land use considers traffic levels and patterns. <br /> ~t. Tral'fic impacts of the proposal should be assessed for adjacent streets and affected <br /> tx~llcctor streets. Impacts resulting in a sa2Fety hazard, increase in fire or police response <br /> lime, or substantial increase in traffic congestion should be mitigated. <br /> b. Potential future travel corridors sl:i0uld be identified and preserved where feasible. <br /> <br /> <br />
