Councilmember Cook commented with the detached townhomes there is a better agreement in
place to protect the wetlands, and there is more greenspace. The buildings are lower profile with
the townhomes, which will give the other residents a better chance to see the wetlands. The
wetlands will be less impacted by this plan than with single-family dwellings. The developer has
done a good job 'on their landscaping to make the wetlands even more attractive from the backs
of the buildings. The developer has done everything that has been requested within their means.
The only thing he sees holding this up is Potassium Street, which the public is already using; it is
just a matter of finding an alignment for it and providing an easement.

Councilmcmber Olson concurred.' She stated she appreciates the work the developer has done on
this. The buffeting is much better than it originally was, and she appreciates their work on
Potassium Street. She likes the overall layout a lot better now.

Mayor Gamec inquired who attempted to contact the two homeowners regarding the road
easement.

Associate Planner Wald replied there will be three owners that need to be contacted. Staff just
recently found out who owned the properties. The reason staff knew the other property owners to
work with is because their attorney contacted them.

Motion by Councilmember Strommen, seconded by Councilmember Jeffrey, to table the request
for preliminary plat and site plan approval of Shade Tree Cottages, Case of Shade Tree
Communities, LLC, to the next City Council meeting.

Further discussion: City Attorney Goodrich indicated staff' will report on the status of Potassium
Street at the next Council meeting. Councilmember Elvig requested information regarding costs
involved with land acquisitions.

Motion carried. Voting Yes:. Mayor Gamec, Councilmembers Strommen, Jeffrey, Cook, Elvig,
Olson, and Pearson. Voting No: None.

Motion by Mayor Gamec, seconded by Councilmember Jeffrey, to accept the petition from the
neighbors surrounding the proposed Shade Tree Cottages and Rum River Estates development.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Cook, Elvig, Olson,
Pearson, and Strommen. Voting No: None.

Case #8: Request to Rezone Property from R-1 Single Family Residential to Planned
Unit Development; Case of Shade Tree Communities

Associate Planner Wald advised Case Nos. 8, 9 and 10. are tied to Potassium Street.

Motion by Councilmember Strommen, seconded by Councitmember Jeffrey, to table the request
to rezone property from R-1 Single Family Residential to Planned Unit Development; Case of
Shade Tree Communities, LLC to the next City Council meeting.

P86

City Council/May 10, 2005
