C. Compliance with Laws and Regulations. The DEVELOPER represents t{) the CITY that the Plat complies with all CITY, County, metropolitan, State and l:edcral laws and regulations, including but not limited to: subdivision ordinances, zoning ordinances and enviromnental regulations. If the CITY determines that the Plat does not comply, the CITY may, at its option, refuse to allow any construction or development work in the Plat until the DEVELOPER does comply. Upon the CITY's demand, the I)IT, VELOPER shall cease work until there is compliance. D. This Agreement shall run with the lind and shall be recorded against the title to the Plait by DEVELOPER. The ~EVELOPER agrees to pay the entire cost of said improvements including interest, engineering and legal charges. I. Plat Ap'proval Expenses. The DEVELOPER agrees that it will pay to the CITY all CITY expel)ses incurred in the approval of the Plat, including, but not limited to administration ex,rises, engineering and legal fees. Said expenses shall be paid within fifteen (15) d~ys of billing by the CITY and outstanding billings shall be paid prior to rec0rding.of }he Final Plat. Any expenses incurred after recording of the Final' Plat shall aisc be paid within said fifteen (15) day billing period. Failure to pay the CITY'S expenses within the fifteen (15) day billing period will permit the CITY to-draw upon any of the escrows required by this contract for payment.
