<br />Councilmember Menth introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #20-198 <br /> <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR <br />DETACHABLE LOADING RAMPS PARTIALLY LOCATED WITHIN A DRAINAGE <br />AND UTILITY EASEMENT AT 6043 HIGHWAY 10 NW AND DECLARING TERMS OF <br />SAME <br /> <br />WHEREAS, Roman Gadaskin, hereinafter referred to as the “Applicant,” have requested <br />an Encroachment Agreement for detachable loading ramps (the “Structure”) that partially <br />encroaches upon a drainage and utility easement (the “Easement”) on the property generally <br />known as 6043 Highway 10 NW and legally described as follows: <br /> <br /> Lot 23, AUDITORS SUBDIVISION No. 96, Anoka County, Minnesota <br /> (the “Subject Property”). <br />WHEREAS, the Applicant has granted the City a drainage and utility easement where one <br />previously did not exist over underground utilities between 6021 Highway 10 NW and 6043 <br />Highway 10 NW; and <br /> <br />WHEREAS, the ramps while secured to the cement landing are secured via bolts that can <br />be detached if need be to allow for any future maintenance on underground utilities to be <br />completed; and <br /> <br />WHEREAS, the City Engineer has found that the moveable ramps will not negatively <br />impact the drainage in the Easement; and <br /> <br />WHEREAS, the Encroachment Agreement will allow the Property Owner to improve the <br />aesthetic looks of the property through the instillation of these movable ramps which will <br />contribute to overall improvement of the Highway 10 corridor which is a goal of the City of <br />Ramsey; and <br /> <br /> WHEREAS, City Council reviewed the request on October 13, 2020. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That, contingent upon the Applicant entering into an Encroachment Agreement with the <br />City, the Applicant may continue to use and maintain the proposed ramps in accordance <br />with the terms and conditions contained within the Encroachment Agreement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
