Councilmember Menth introduced the following resolution and moved for its adoption: <br />RESOLUTION #20-230 <br />RESOLUTION APPROVING DRAINAGE AND UTILITY EASEMENT <br />ENCROACHMENTS FOR EAVE OVERHANGS IN THE RIVERSTONE 4th ADDITION <br />SUBDIVISION <br />WHEREAS, Riverstone Development LLC, hereafter referred to as "Developer", has <br />requested a one (1) foot drainage and utility easement encroachment for the lots commonly known <br />as 15183, 15175, 15174 and 15182 Quintana Court and legally described as: <br />Lot 6, 7, 16 and 17, Block 1, Riverstone 4th (respectively), Anoka County, Minnesota <br />(the `Subject Properties'); <br />WHEREAS, the City Engineer has stated that the impacted drainage and utility easements <br />will still properly function with said encroachment; and <br />WHEREAS, the City of Ramsey reviewed and approved the easement encroachment <br />agreement on October 13, 2020. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 'IHL CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants a one foot easement encroachment agreement <br />for a one foot eave overhang for the Subject Properties into the side yard ten (10) foot <br />drainage and utility easement. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor LeToumeau <br />Councilmember Menth <br />Councilmember Riley <br />Councilmember Kuzma <br />Councilmember Musgrove <br />Councilmember Specht <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />
