He <br />iuquircd il' there would be some sort of an agreement that could be struck. <br /> <br />C¢~uncil~nember Cook stated this would have nothing to do in regards to Mr. Hamilton's request <br />Ibr' a std, division. <br /> <br />£:ity Attorney Goodrich advised the Hamiltons know the plant exists and are building their new <br />home with that understanding. It would be somewhat hard pressed for the Hamiltons to <br />complain about the odor with their knowledge of the plant. <br /> <br />Mofio~ by Councilmember Cook, seconded by Councilmember Strommen, to adopt Resolution <br />,705-05--132 to waive the platting requirements outlined in Section 9.50 (Subdivision) of the <br />[4amscy City Code and approve a subdivision by metes and bounds of Tract C, Registered Land <br />Survey No. I99, in accordance with Section 9.50.07 (Filing and Recording Conveyances) of the <br />Ramscy City Code. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Jeffrey, <br />Olson, and Pearson. Voting No: None. <br /> <br />{:ase #7: <br /> <br />Request for Preliminary Plat and Site Plan Approval of Shade Tree <br />Cottages; Case of Shade Tree Communities, LLC <br /> <br />Associmc Planner Wald indicated Shade Tree Communities, LLC has applied for preliminary <br />plat and site plan revievv to develop a residential Planned Unit Development (PUD) subdivision <br />on the property generally located west of Potassium Street and east of Nowthen Blvd. (County <br />I~oad 5). The subject property is 28 acres in size and zoned R-1 Single Family. City Code <br />restricts density to three units per acre or up to four units per acre through a PUD. The City <br />Council will be reviewing thc applicant's request to rezone the property from R-1 to PUD <br />stthscquent to this case. The request for a rezoning relates to the utilization of both single family <br />and t,>wnhomcs within the development and to address deviations from City Code related to <br /> <br />City Council/May 10, 2005 <br />Page 13 of 31 <br /> <br /> <br />
