CITY COUNCIL WORK SESSION <br />Topic Report: Nextera Communications <br />By: Heidi A. Nelson, Asst. City Administrator <br /> <br />Background: <br /> <br />Nextera Communications is a telecommunications company that has installed utilities <br />within the Town Center project area for the purpose of delivering telephone, data and <br />cable TV. As Council is aware, Comcast is currently the only cable TV provider in the <br />City of Ramsey and has a current franchise with the City of Ramsey to provide those <br />services. Nextera Communications has requested to provide cable TV services within the <br />Town Center without a franchise, referencing provisions of state statute that exempts <br />certain systems fi'om the franchising requirements. <br /> <br />Quad Cities Cable Commission staff and legal counsel have been corresponding with the <br />legal counsel for Nextera Communications, a copy of the most recent correspondence is <br />attached for Council review. It is the opinion of QCTV's attorney, Steve Guzzetta and <br />city staff that Nextera would be subject to franchising requirements per state and federal <br />law. Steve Guzzetta of Bradley & Guzzetta, LLC will be present for the work session <br />discussion. Staff is seeking direction from Council regarding the franchising requirement <br />tbr a competitive franchise for cable TV in the City of Ramsey. <br /> <br />Action Statement: <br /> <br />Based upon discussion. <br /> <br />CCWS: 06/14/2005 <br /> <br /> <br />
