INTEROFFICE MEMORANDUM <br /> <br />TO: CITY COUNCIL <br />FROM: MEGAN WALD, ASSOCIATE PLANNER <br /> <br />SUBJECT: PETITION FROM NEIGHBORS <br />DATE: 5/10/2005 <br /> <br />The City is in receipt of a petition from the neighbors surrounding the proposed Shade Tree <br />Cottages and Rum River Estates development. This memo is to address the information <br />provided in their petition: <br /> <br />The R-1 District allows the development of single family and townhome units with~ <br />the R-1 district if the proposed development is processed as a PUD. The fact that <br />City Code does not adequately define all types of townhomes does not mean that the <br />style of home is not allowed. To site an example of where the City has allowed the <br />development of detached townhomes within the R-1 District, staff would refer to <br />Village of Sunfish Lake and Mallard Ponds subdivisions. <br /> <br />Detached to~vnhomes are not the same as a single family home as they do not have a <br />"typical" lot or "owner owned yard." Townhomes are different from single family <br />homes in that the land surrounding the footprint of the unit is owned by the Home <br />Owners Association. Since the detached units are townhouses, City Code specifically <br />states that townhomes should be reviewed Under the R-2 standards related to size <br />and setbacks. <br /> <br />City Code allows t0wnhome developments to be processed as a PUD within the R-1 <br />District. Furthermore, density is permitted up to 4 units per acre as compared to 3. <br />units per acre for a single family subdivision plan. The purpose of the preliminary <br />plat process is to address and work through any drainage, traffic, and safety issues. <br /> <br />Rum River Estates is not subject to density transition. Shade Tree Cottages is <br />proposing to satisfy their density transition requirements through a berm and a <br />vegetative landscaped area. <br /> <br />5. Both Shade Tree Cottages and Rum.River Estates will maintain the R-1 MUSA land <br /> use designation. <br /> <br /> <br />
