WHEREAS, 14 feet of the necessary right of way for Potassium Street lying north of PIN # 23-32-25-12-0006 can be dedicated within the Plat; and WHEREAS, the balance of the 60 foot right of way or 46 feet needs to be acquired from the properties lying east of the Plat and lying north of that PIN# 23-32-25-12-0006; and WHEREAS, the westerly 66 feet of PIN 23-32-25-12-0006 appears available for Potassium Street right of way; and WHEREAS, the westerly 66 feet of Potassium Street lying within the Southwest Quarter of the Northeast Quarter of Section 23, Township 32, Range 25 lying north of Old County Road 5 is available for Potassium Street right of way; and WHEREAS, the City will need to acquire either through direct negotiations or eminent domain proceedings, the Potassium Street rights of way referenced above; and WHEREAS, on May 10, 2005, the City Council reviewed the preliminary plat for the P lat, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITYOF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA; The City Council ~a~tS~:ge_~,e.A preliminary plat approval for the plat CONTINGENT upon the lbllowing conditions: 1. Compliance with City staff review letter dated May 6, 2005; 2. The City having acquired marketable title to the following permanent easements necessary for the Potassium Street right-of-way: Parcel 1: That part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 32 North, Range 25 West, described as follows: Commencing at a point on the west line of said Northwest Quarter of the Northeast Quarter, distant 330.39 feet south of the Northwest Comer of the Northwest Quarter of the Northeast Quarter; thence South 660.78 feet along west line of said Northwest Quarter of the Northeast Quarter; thence east 46 feet; thence north 660.78 feet on a line parallel to the west line of said Northwest Quarter of the Northeast Quarter; thence west 46 feet to the point of commencement. Parcel 2: That part of the Northwest quarter of the Northeast Quarter of Section 23, Township 32 North, Range 25 West, described as follows: Commencing at a point on the west line of said Northwest Quarter of the Northeast Quarter, distant 991.17 feet south of the Northwest Comer of the Northwest Quarter of the Northeast Quarter; thence South 33 feet along west line of said Northwest Quarter of the Northeast Quarter; thence east 46 feet; thence north 33 feet on a line parallel to the west line of said Northwest Quarter of the Northeast Quarter; thence west '46 feet to the point Of commencement.
